Terms of Use for meanttobeefloristry.com

Introduction

Welcome to meanttobeefloristry.com (the "Site"), the online home of Meant to Bee Floristry ("we", "us", or "our"). This Site allows you to browse our floral arrangements and place orders for local delivery and pickup. By accessing or using our Site (including placing an order), you agree to these Terms of Use ("Terms"). If you do not agree with these Terms, please do not use the Site.

You must be at least 18 years of age (or the age of majority in your jurisdiction) to place an order on our Site. If you are under 18, you may use the Site only with the involvement and permission of a parent or legal guardian.

These Terms outline the conditions under which we provide our services. We strive to maintain a professional, friendly service, and we ask that you use our Site responsibly. Please read these Terms carefully. If you have any questions, feel free to contact us using the information at the end of this document.

Placing Orders and Payment

You may browse our products without an account. When you're ready to place an order, you will need to provide certain information at checkout (see the Personal Data & Privacy section below). All prices on our Site are listed in U.S. dollars and do not include applicable taxes or delivery fees, which will be added at checkout.

Payment: A valid payment method (such as a credit or debit card) is required to complete your purchase. By submitting your payment information, you authorize us to charge the specified amount for your order. Payment is processed at the time of order placement. If your payment is declined or if there are billing issues, we will not be able to process your order. We reserve the right to cancel any order if payment cannot be processed or if we suspect fraudulent activity.

Order Confirmation: After you place an order, you should receive an order confirmation (e.g., on-screen and/or via email) summarizing your order details. If you do not receive confirmation, please contact us to ensure your order was received.

Product Availability and Substitution: All products on our Site are subject to availability. Because we use fresh flowers and seasonal materials, there may be occasions when a particular bloom or item is unavailable. If we cannot fulfill part of your order exactly as requested, we reserve the right to substitute an item of equal or greater value and similar style or color. We will make every effort to maintain the look and feel of your chosen arrangement. If we are unable to supply your order at all, we will notify you as soon as possible and issue a full refund.

Local Delivery Policy

We currently offer local pickup only within our service area. Meant to Bee Floristry is based in Myrtle Beach, South Carolina, and we have pickup available in the Myrtle Beach are. We do not ship or deliver our floral arragenemnts. Please ensure the pickup address for your order is within your local service area; otherwise, we will be unable to fulfill the order.

Pickup Timeframes: We will provide an estimated pickup date (and time window, if applicable) when you place your order. While we strive to have your flowers ready on the requested date and time, unexpected factors like supply delays or weather may occasionally affect preparation. We do not guarantee an exact pickup time but will do our best to ensure your order is ready when expected and will communicate with you if any delays arise.

Pickup Process: Orders must be picked up during our business hours, which may vary by day or season and will be listed on our Site or in your order confirmation. On the scheduled pickup day, we’ll have your arrangement prepared and ready at our designated pickup location. It is your responsibility to arrive within your scheduled window and to ensure you or your designated pickup person has the necessary order details. We are not responsible for missed pickups or compromised product quality due to late or forgotten pickups.

If the Order Is Not Picked Up: If an order is not picked up during your scheduled time, we will attempt to contact you using the information provided at checkout to arrange an alternative pickup time. However, please note that we cannot guarantee the freshness or quality of arrangements held beyond the original pickup window.

If we do not hear from you within a reasonable time after the scheduled pickup, the flowers may no longer be suitable for pickup, and the order will be considered fulfilled. We are not responsible for missed pickups or product deterioration due to delays beyond our control. We strongly recommend setting reminders and arriving promptly to ensure the best quality.

Pickup Delays: In rare cases of severe or unforeseen circumstances (e.g., extreme weather, supply chain disruptions, power outages, or local emergencies), we may not be able to have your arrangement ready on the originally scheduled pickup day. If this happens, we will make every effort to notify you as soon as possible and reschedule your pickup for the next available business day. While we understand that delays can be frustrating, please note that we cannot offer refunds for delays caused by circumstances beyond our control, as long as we are able to fulfill your order at the next reasonable opportunity.

Cancellation Policy

We understand that plans can change. If you need to cancel an order, you must request the cancellation at least 14 days (2 weeks) before the scheduled delivery date to be eligible for a refund. Cancellations requested with more than two weeks' notice will be honored with a full refund (excluding any non-refundable transaction fees that our payment processor may charge, if applicable).

Cancellations requested within 14 days of the delivery date may not be accepted because we likely have already procured flowers and materials or begun preparing your arrangement. Once we are within two weeks of your delivery date, all sales are considered final. If you contact us to cancel after this cutoff, we reserve the right to refuse the cancellation or to offer only a partial refund at our discretion (for example, if only some costs can be recovered).

If your order has already been prepared or is ready for pickup, it cannot be canceled or refunded (see the Refund Policy below for issues with the product after pickup).

To cancel an order, please contact us as soon as possible with your order details. The easiest way to request a cancellation is by reaching out via the contact information on our Site. Cancellation timing will be determined based on when we receive your request, so we strongly encourage you not to wait until the last minute.

In the rare event that we must cancel your order (for example, due to unforeseen circumstances on our end), we will inform you as soon as possible and you will receive a full refund.

Refund Policy

Your satisfaction is important to us. However, due to the perishable and custom-made nature of our products, our refund policy is limited. All sales are final once the floral arrangement has been picked up, with exceptions only for cases of damaged or incorrect products as described below.

No Refunds After Pickup (Except for Issues): We do not offer refunds or returns for floral arrangements once they have been picked up, unless the product is damaged, defective, or significantly incorrect. Each arrangement is custom-made with fresh materials, so once it leaves our care in good condition, the sale is considered complete and final.

Damaged or Incorrect Products: If you receive an arrangement that is damaged, wilted, or not what you ordered (for example, you received a completely different item than what was in your order confirmation), please let us know immediately. Contact us as soon as possible, ideally within 24 hours of pickup, to report the issue. You can reach out via the Contact Us section in our Home Page. Please provide details of the problem, and if possible, include a photo of the arrangement so we can see what went wrong.

Once we verify the problem (for example, by reviewing the photo of the damaged/wrong item or investigating the order details), we will offer a resolution. In most cases, our resolution will be one of the following:

  • Replacement: We may offer to deliver a new floral arrangement as a replacement, free of charge, as soon as possible.

  • Refund: If a replacement is not feasible or you prefer a refund, we can issue a refund for the affected product. Refunds will be processed back to the original payment method used. Please note it may take several business days for the refunded amount to appear in your account, depending on your bank or card issuer.

We reserve the right to require reasonable proof of the issue (for example, requesting a photo of the damaged or incorrect item) before processing a refund or replacement. Our goal is to ensure you receive the beautiful flowers you ordered, so we will work with you in good faith to fix any problems within our control.

No "Change of Mind" Refunds: We cannot offer refunds if you simply change your mind about the order or no longer need the flowers after pickup, as long as the correct items were delivered in good condition as described.

This refund policy does not affect any rights you may have under applicable consumer protection laws. We will always abide by any legal obligations regarding customer rights and remedies.

Personal Data & Privacy

Your privacy and the security of your personal information are very important to us. When you use our Site or place an order, we collect certain personal data from you. This section explains what information we collect and how we use and protect it.

Information We Collect: During checkout (or account creation, if you create an account), we will ask you to provide information such as:

  • Name – Your name and the recipient’s name (if you are sending to someone else).

  • Contact Information – Your phone number and email address (so we can send order confirmations and reach you if needed), and the recipient’s phone number (to assist with delivery if necessary).

  • Addresses – The billing address associated with your payment method, and the delivery address for your order.

  • Payment Details – Payment information such as credit card number, expiration date, and CVV (which are processed securely via our payment provider). We do not store full credit card numbers on our servers after the transaction.

We use this information solely for the purposes of processing your order, delivering the flowers, and communicating with you about your purchase. For example, we will use your email to send an order receipt and any updates about your delivery, and we might use your phone number to contact you (or the recipient) if there is an issue with delivery or to confirm information.

Protection of Personal Data: We are committed to protecting your personal data. We implement reasonable security measures (both technical and organizational) to safeguard the information you provide. For instance, our site uses encryption (HTTPS) to protect data transmissions, and sensitive payment information is handled by secure, PCI-compliant payment processors. We do not store your payment card details on our systems beyond what is necessary to process the transaction.

We will never sell, rent, or trade your personal information to third-party marketers. We may share your data with trusted third parties only as needed to fulfill your order and operate our business. For example, this can include sharing the delivery details with our delivery staff or courier, processing your payment through our payment gateway provider, or using an email service to send order confirmations. Any third-party service providers we engage are required to use your information solely for the services requested (e.g., processing payment or delivering the order) and to protect your information in accordance with applicable laws.

Compliance with Privacy Laws: We handle personal information in accordance with applicable privacy laws and regulations. Since we operate in the United States, this includes federal and state laws regarding customer data. If you are in a jurisdiction with additional data protection laws (such as the European Union), we will take steps to comply with those laws if they apply. By using our Site and providing your personal information, you consent to our collection and use of your data as described in these Terms.

If you have any questions about how we handle personal data, or if you wish to update or delete your information, please contact us (see Contact Us section below). We respect your privacy rights and will do our best to address any concerns.

User Responsibilities and Acceptable Use

When using meanttobeefloristry.com, we ask that you do so responsibly and lawfully. By accessing our Site, you agree to the following:

  • Provide Accurate Information: You agree that any information you provide to us (such as contact details, delivery information, and payment details) is truthful, accurate, and current. You are responsible for keeping this information up-to-date. For example, if you create an account with us, keep your contact information and addresses current. Do not impersonate any other person or misrepresent your identity when using the Site.

  • Account Security (if applicable): If our Site allows you to create an account and you choose to do so, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Use a strong password and do not share it. If you suspect any unauthorized use of your account, notify us immediately. We are not liable for any loss or damage arising from your failure to protect your account information.

  • Use the Site for Intended Purposes: Our Site is intended for your personal use (or legitimate business use if you are buying on behalf of a company) to browse and purchase floral products. You agree not to misuse the Site. In particular, you will not:

    • Use the Site for any unlawful purpose or violate any local, state, national, or international law or regulation in connection with your use of the Site.

    • Infringe upon our rights or the rights of others, including intellectual property rights. (For example, you will not copy or reuse content from our Site without permission, as described in the Intellectual Property section.)

    • Engage in fraudulent or deceptive practices on the Site (such as using a false identity or using someone else’s credit card without authorization).

    • Attempt to interfere with or disrupt the proper functioning of the Site. This includes not introducing any viruses, malware, or harmful code; not attempting to hack, gain unauthorized access to, or otherwise breach the security of the Site or our systems; and not engaging in any activity that overwhelms or attacks the Site (e.g., a denial-of-service attack).

    • Use any automated means (such as bots, scrapers, or scripts) to access, monitor, or collect data from the Site without our explicit written permission.

    • Send any unsolicited or unauthorized advertisements, spam, or bulk communications through or about the Site.

  • No Offensive or Illegal Content: If the Site allows you to enter or transmit any content (for example, writing a gift message to accompany a delivery or sending a message through a contact form), you agree not to submit anything that is offensive, obscene, harassing, libelous, or illegal. Any message to be delivered with your flowers should be appropriate and lawful. We reserve the right to refuse to transmit or remove any content you submit that we determine, in our sole discretion, to be inappropriate or in violation of these Terms or any laws.

If you violate any of the above responsibilities or acceptable use rules, we may take action including canceling your orders, terminating your account (if you have one), or restricting your access to the Site. Serious violations (especially illegal activities) may be reported to law enforcement. We hope to never have to take these steps, so please use our Site in good faith and with respect for these Terms and other users.

Intellectual Property

All content and materials on meanttobeefloristry.com are the property of Meant to Bee Floristry or our content licensors, and are protected by intellectual property laws. This includes (but is not limited to) all text, descriptions, photographs of floral arrangements, images, graphics, logos, button icons, videos, audio clips, and software on the Site, as well as the design, selection, and arrangement of such content.

Limited License for Personal Use: We grant you a limited, revocable license to access and make personal use of our Site and its content for the purpose of viewing, browsing, and ordering our products. You may not download (other than page caching) or modify the Site, or any portion of it, except with our express written consent. This license does not allow you to: resell or commercially use our Site or content; collect or use product listings, descriptions, or prices for the benefit of another merchant; make derivative uses of the Site or its contents; download or copy account information for the benefit of another party; or use data mining, robots, or similar data gathering and extraction tools without our permission.

No Unauthorized Reproduction: You may not reproduce, duplicate, copy, sell, or otherwise exploit any portion of the Site (including content, images, and designs) for any commercial purpose without our express written consent. You are, however, welcome to share links to our Site or our products on social media or with friends/family for personal purposes.

Trademarks: The name "Meant to Bee Floristry", our logo, and any other trademarks or service marks displayed on the Site are owned by us (or used under license). You are not granted any right or license to use any trademarks featured on our Site without our prior written approval. This means you cannot use our business name or logo in any manner likely to cause confusion among customers or dilute or tarnish our brand.

Any unauthorized use of the Site or its content will terminate the permission or license granted by these Terms. We reserve all rights not expressly granted to you. If you wish to use any content from our Site beyond what is allowed by these Terms or by law (such as fair use exceptions), please contact us to request permission.

Limitation of Liability

We strive to provide a safe, reliable website and to deliver high-quality products. However, it’s important to understand that our legal liability to users is limited. By using our Site, you acknowledge and agree to the following limitations on our liability:

Use of the Site (As-Is Disclaimer): We provide the Site and its content on an "as is" and "as available" basis. While we aim to keep information up-to-date and the Site running smoothly, we make no guarantee that the Site will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, Meant to Bee Floristry disclaims all warranties of any kind (express or implied) regarding the Site and your use of it, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In plain terms, we cannot promise that the website will always work perfectly or meet all your expectations, but we will do our best to operate it effectively.

Product and Service Quality: We stand behind the quality of our floral products to the extent described in these Terms (for example, our commitment that flowers will arrive fresh and in good condition, or that we will provide a remedy if they do not). However, aside from any explicit guarantees stated (such as our refund/replacement policy for damaged products), our products and services are provided without additional warranties. Flowers are natural and perishable items; their condition can be affected by how they are cared for after delivery, which is beyond our control. We do promise that orders will be fulfilled as described (with allowable substitutions as noted) and delivered with care, but we do not make broader guarantees beyond those commitments.

Limitation of Damages: To the maximum extent allowed by law, Meant to Bee Floristry and its owners, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damagesarising out of or relating to your use of the Site or purchase of our products. This includes, for example, any loss of profits, loss of data, or other intangible losses that result from: (a) your use of or inability to use the Site, (b) any content obtained from the Site, or (c) unauthorized access to or alteration of your transmissions or data.

In all cases, our total liability to you for any claim arising from or related to your use of the Site or purchase of products is limited to the amount you paid for the product or service in question. For example, if you paid $50 for an arrangement that gave rise to a claim, our liability to you will not exceed $50. If you did not make a purchase and are just using the free portions of our Site, then we owe no monetary damages to you (since you have not paid us anything).

Exceptions: Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not fully apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

Third-Party Links and Services: Our Site may contain links to third-party websites or use third-party services (for example, a payment processing service or map integration for addresses). These third-party sites and services are not under our control, and we are not responsible for their content or performance. We provide these links/services for convenience and do not endorse them. If you access third-party websites or services through our Site, you do so at your own risk. Meant to Bee Floristry will not be liable for any damages or losses arising from your use of any third-party site or service.

Indemnification

You agree to indemnify and hold harmless Meant to Bee Floristry and our owners, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) that arise out of or relate to your use of the Site or our services, your violation of these Terms, or your violation of any law or the rights of any third party.

In simpler terms, if your actions (or inactions) result in us being sued or incurring expenses due to your breach of these Terms or your illegal conduct, you agree to step in and cover those costs. For example, if you use our Site in a way that infringes someone else’s rights and that person brings a claim against us, or if you violate these Terms and it causes us damage, you will be responsible for the costs and damages we suffer as a result.

We will notify you promptly if we receive any third-party claim against us that we believe is covered by this indemnity. You agree to cooperate with us in defending such a claim, and to allow us to assume the defense and control of the matter if we choose. (If we do take control of the defense, we will not do so in a way that unreasonably compromises your rights, and you will not be required to admit liability or pay any amount without your agreement.) This indemnification obligation will survive the termination of these Terms and your use of the Site.

Governing Law and Jurisdiction

These Terms of Use, and any disputes arising out of or related to the Site or any orders placed through the Site, shall be governed by the laws of the State of South Carolina, and, to the extent applicable, the federal laws of the United States. This governing law applies without regard to conflicts of law principles, meaning that if you live in a different state or country, and that would normally lead to a different law applying, we still agree that South Carolina law will govern to the maximum extent possible.

By using the Site or placing an order, you agree that any dispute or claim between you and Meant to Bee Floristry will be resolved by courts located in the State of South Carolina. You consent to the personal jurisdiction of South Carolina courts (state or federal) for the purpose of litigating any such dispute. If you are a customer located in a different state or country, you acknowledge that you are voluntarily accessing the Site and that South Carolina is an appropriate and convenient venue for resolving any legal disputes.

Consumer Rights Notice: Nothing in this section is intended to violate any laws regarding consumer protection or mandatory legal rights. If applicable law in your jurisdiction gives you the right to resolve disputes in your local courts or under different law, those rights are not waived. However, to the extent permitted, the law of South Carolina will apply and any disputes will be brought in South Carolina courts.

Miscellaneous

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed (removed) from these Terms. The remaining provisions of these Terms will remain in full force and effect. In other words, if one part of the agreement is invalid, the rest of the agreement still applies.

No Waiver: If we fail to enforce any part of these Terms, or delay in enforcing our rights, it does not mean we are giving up those rights. No waiver of any breach or default under these Terms will be effective unless made in writing by us, and no such waiver shall be deemed to be a waiver of any subsequent breach or default. If we choose not to act on a violation of these Terms, we still have the right to enforce the Terms in the future for that same violation or others.

Entire Agreement: These Terms of Use (along with any other policies or guidelines posted on our Site, such as our Privacy Policy or any order-specific terms) constitute the entire agreement between you and Meant to Bee Floristry regarding your use of the Site and our services. They supersede any prior agreements or communications between you and us, whether oral or written, regarding the same subject matter.

Headings: The section titles (headings) in these Terms are for convenience only and have no legal effect.

Changes to These Terms

We may update or modify these Terms of Use from time to time. We reserve the right to make changes in order to reflect our current practices, comply with legal requirements, or for any other reasonable purpose. When we make changes, we will post the updated Terms on this page and update the "Last Updated" date (if provided at the top of the Terms). Changes will become effective immediately upon posting unless otherwise noted.

It is your responsibility to review these Terms periodically for any updates. By continuing to use the Site or our services after new Terms are posted, you agree to the revised Terms. If you do not agree with any update to the Terms, you should stop using the Site and (if applicable) cancel any pending orders that are subject to the new terms (subject to our Cancellation Policy).

For significant changes that materially affect your rights or obligations, we may attempt to notify you through additional means, such as via the email address you provided with an order or by a prominent notice on our homepage. However, regardless of whether additional notice is given, the posted Terms will be binding. We encourage users to check the Terms of Use each time they place an order.
